We’ve all heard of plenty of celebrity sex tape scandals, but the newly-uncovered Eric Dane and Rebecca Gayheart footage is definitely a new take on things.

According to the “Grey’s Anatomy” actor’s lawyer, the video, which also includes Miss Teen USA 2002 Kari Ann Peniche, isn’t exactly a sex tape.

Marty Singer told press, "This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public."

He continued, "Although the participants are nude, the tape is not a 'sex tape.' It is a private tape made for only my clients' personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients' rights and will be exposed to significant liability."

According to a report, Dane, Gayheart, and Peniche pass a camera around while appearing intoxicated. At one point they take a bath in a Jacuzzi tub and lay around naked in bed while discussing their porn names.
