Kelly Rutherford Talks Custody Loss on "Good Morning America"
After a disappointing loss in family court, Kelly Rutherford sat down with "Good Morning America" on Saturday (September 1) to discuss the custody fight with ex-husband Daniel Giersch.
The "Gossip Girl" actress and Giersch have a 5-year-old son and 3-year-old daughter who a judge just ruled must stay in France with their father, who is blocked from the U.S. by a revoked visa.
In order for Kelly to see her children, she must travel to France. Though she requested a stay on the judgment pending appeal to allow the children to return to New York, that motion was denied.
The 43-year-old actress talked about the controversial ruling. "I’m all for 50/50 and all for children having a mother and father and co-parenting — it’s just that the way it’s set up now — I’m a working mother, I’ve been the sole supporter of my children for their entire lives, and I have a job… I’m going to do my best to be there obviously every chance I get, but I can’t just be there on a regular basis when I have to work and — I mean, I just can’t pick up and go, you know, that easily.”
We haven't seen the last of litigation, however. Ms. Rutherford says, “I will never stop fighting for my children. They’re my babies and they’re very young and this is going to affect them profoundly, and I want to be there as much as I can to show them that this isn’t my fault, this isn’t something I wanted.”
