Sampling is a huge part of hip hop, but unfortunately Drake got into a little legal trouble over using a clip of an old jazz tune.

The estate of Jimmy Smith is suing the "Started From the Bottom" singer for using "Jimmy Smith Rap" at the beginning of his song, "Pound Cake/Paris Morton Music 2."

On his album Nothing Was the Same, the liner notes claim that the monologue was licensed.

However, the lawsuit says the estate was never contacted about using the clip and is seeking over $300,000 in damages.
